California owner operators are realizing that the owner
operator business model may no longer be legal.
As of January 1, 2020
the AB5 law will force owner operators to become employees of the companies
that they haul freight for.
The above parties, CALIFORNIA
TRUCKING ASSOCIATION, RAVINDER SINGH, and THOMAS ODOM are attempting to fight
this law.
Plaintiffs bring this lawsuit to vindicate their rights
guaranteed by the
Supremacy Clause and Commerce Clause of the United States
Constitution.
Plaintiffs seek declaratory and injunctive relief
prohibiting the Defendants from
applying and enforcing California’s new test for whether a
worker is an employee or
independent contractor…
The California Truckers Association (CTA) make numerous references
to its “members” or owner operators. CTA and Singh and Odom are fighting
specifically the ABC test. This is the test that will disqualify owner
operators from being independent contractors.
It is highly recommended that all owner operators read the
lawsuit filing. The effects of AB5 on truckers and owner operators is spelled

AB5 California Trucking has vast implications on truckers
and owner operators.
One question many of us have is how will truckers or owner operators
with specialized trailers be affected by AB5. When you have a specialized trailer
such a an removable goose neck (RGN) , you will be hauling for numerous customers.
The same applies for hot shot truckers who haul for numerous
customers.
It is already known that Swift and Werner are already ending agreements with leased owner-operators in California.
This means that leased drivers may have to make the decision to start driving under their own operating authority.
This new law also drastically impacts the way the trucking industry in California operates.
The new law assumes workers are employees. To prove otherwise, the hiring company has the burden of demonstrating that the worker meets a very specific test.
Namely, a worker can only be classified as an independent contractor if the company can show that the worker meets all three of the following prongs:
A – The worker is free from control and direction in the performance of services; and
B – The worker is performing work outside the usual course of the business of the hiring company; and
C – The worker is customarily engaged in an independently established trade, occupation, or business.
Prong B will be the biggest obstacle for hiring companies in the trucking business.
For example, if the hiring company’s business is trucking, transportation, or logistics, then it will be very difficult for the company to show the truck drivers they contract with are performing work outside of the usual course of the company’s business.
The Western States Trucking Association has told its members the new law, particularly Prong B, “sets an impossible standard for most of its members to meet.”
Even then, the drivers would still have to be free from the hiring company’s control (Prong A) and have an independently established business or provide trucking services to other companies (Prong C).
